Kiberflow Terms of Service

Effective 18 September 2026

These terms govern your use of Kiberflow (https://kiberflow.app), operated by Kibernetika Inc., 806 E Homestead Rd, Sunnyvale, CA 94087, USA ("we", "us"). By creating an account or using the service you agree to them. How we handle your data is described separately in our Privacy Policy, which forms part of these terms.

1. What Kiberflow is

Kiberflow is a workspace where users converse with an AI assistant over their own documents and datasets, extract structured data from files, and review usage and answer quality in analytics. The assistant can optionally be connected to third-party services so it can answer questions using data from those services.

2. Accounts and eligibility

You must be at least 18 years old and able to enter a binding contract. You are responsible for the accuracy of your account details, for keeping your credentials confidential, and for everything done under your account. Tell us promptly at privacy@kibernetika.ai if you believe your account has been used without your authorization. An organization administrator may invite, manage and remove users within their organization, and may access workspace content their role permits.

3. Acceptable use

You may not use Kiberflow to break the law, to infringe anyone's rights, to upload content you have no right to upload, or to process personal data you are not permitted to process. You may not attempt to gain unauthorized access to the service or to other customers' data, interfere with its operation, circumvent usage limits, or use it to generate unlawful, deceptive or abusive material. We may suspend access that threatens the security or availability of the service for others.

4. Your content

You keep all rights in the documents, datasets, messages and other content you bring to Kiberflow. You grant us only the licence needed to run the service for you: to store, process, index and display that content, and to transmit it to the model providers and third-party services required to produce the output you requested. We do not sell your content and we do not use it to train models.

5. Third-party services and connectors

Connecting a third-party service โ€” a Google connector, a messenger, a voice provider or an external app โ€” is initiated by you, takes effect only after you grant consent on that provider's own screen, and can be revoked by you at any time. Your use of those services remains governed by their terms, and we are not responsible for their availability or for changes they make. What we access through a connector, and how long we keep it, is set out in the Privacy Policy.

6. AI-generated output

The assistant produces output probabilistically and can be wrong, incomplete or outdated. Output is not professional advice. Review it before relying on it, and do not use it as the sole basis for decisions with legal, financial, medical or safety consequences.

7. Plans, credits and billing

Paid plans and credit bundles are described at the point of purchase. Fees are charged in advance for the period or bundle selected, are stated exclusive of taxes, and are non-refundable except where required by law. We may change prices for future periods with notice before the change takes effect. Failure to pay may result in suspension of the account.

8. Availability and support

We aim to keep Kiberflow available and to give notice of planned maintenance where practical, but the service is provided without an uptime commitment unless a separate written agreement says otherwise. We may modify or discontinue features; where a change materially reduces functionality you rely on, we will give reasonable notice.

9. Disclaimer of warranties

To the fullest extent permitted by law, Kiberflow is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure or error-free.

10. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data, arising out of or relating to these terms. Our total liability for all claims relating to the service in any twelve-month period is limited to the amounts you paid us for the service in that period. These limits do not apply to your payment obligations or to liability that cannot be limited by law.

11. Suspension and termination

You may stop using Kiberflow and delete your account at any time. We may suspend or terminate access for a material breach of these terms, for non-payment, or where required by law, with notice where practical. On termination your right to use the service ends; content is removed in line with the retention periods in the Privacy Policy. Export your data before you close your account.

12. Changes to these terms

We may update these terms. If a change materially affects your rights we will notify affected users before it takes effect. Continuing to use Kiberflow after that date means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the State of California, USA, excluding its conflict-of-law rules. The state and federal courts located in Santa Clara County, California have exclusive jurisdiction over disputes arising from them.
